ESMA Names AI and Tokenization a Top EU Supervisory Priority Starting in 2027

The European Securities and Markets Authority set a new Union Strategic Supervisory Priority focused on digital innovation, to take effect in 2027, according to its press release. The designation directs national securities regulators across the EU to concentrate supervisory attention and resources on a specific area the authority considers high-risk for investor protection and market stability, a mechanism ESMA has previously used for priorities such as cyber and operational resilience.

The new priority explicitly names two technology areas. On artificial intelligence, supervisors will focus on how regulated entities such as investment firms and asset managers implement AI systems in their operations and client-facing services. On tokenization, the authority will monitor how financial firms adopt tokenized assets and the infrastructure supporting them, an area that has expanded rapidly across EU markets over the past two years.

ESMA said the framework is designed to stay flexible enough to address technological developments that have not yet emerged, rather than locking supervisors into a fixed list of specific products or techniques. The digital innovation priority will run alongside the cyber and operational resilience priority that has been active since 2025, while the ESG-disclosures priority that launched in 2023 is being phased out this year to make room for the new focus areas.

“How supervised entities use artificial intelligence and tokenisation” will be the core of the new priority’s scope, ESMA said, adding that it intends to remain “flexible to address future technological developments as they emerge.” Union Strategic Supervisory Priorities function as convergence tools, steering national regulators toward consistent supervisory focus on the areas ESMA judges most significant for investor protection and orderly markets across the bloc.

The move formalizes AI and tokenization as top-tier EU regulatory concerns heading into 2027, giving financial firms operating in the bloc a clearer signal of where supervisory scrutiny is likely to intensify as both technologies see wider adoption across asset management, trading, and market infrastructure.

Because Union Strategic Supervisory Priorities direct where national regulators concentrate their own examination and enforcement resources rather than creating new binding rules on their own, firms operating AI-driven advisory tools or tokenized-asset platforms in the EU should expect closer questioning from national regulators starting in 2027 even before any new legislation specific to either technology is proposed at the EU level.
