EU Reopens MiCA for Review Three Years After It Became Law

The European Commission has opened a targeted consultation on revising its Markets in Crypto-Assets regulation, known as MiCA, three years after the framework became law and roughly two years after it took full effect across the bloc. MiCA was the first comprehensive crypto regulatory framework adopted by a major economic bloc, and its passage was widely held up as evidence that the EU had moved ahead of the United States in providing legal clarity for the crypto industry.

The consultation seeks input on specific areas of the framework that industry participants and regulators have identified as needing adjustment, though the Commission has not yet published a full list of proposed changes ahead of gathering feedback. Areas commonly cited as friction points in MiCA’s current implementation include inconsistent application of licensing standards across different member state regulators, a gap the passporting system was originally designed to eliminate but which recent reporting around a major exchange’s licensing process in Greece suggests may persist in practice.

The timing of the review is notable given developments on the other side of the Atlantic. The United States has moved aggressively on crypto-adjacent regulation in recent weeks, with the SEC’s new tokenized stock exemption and the CFTC’s expanded no-action relief both landing within days of each other, even as the broader CLARITY Act remains stalled in the Senate. That contrast, a comprehensive EU framework already three years old needing revision, against a more fragmented but currently fast-moving US regulatory approach, has fed a broader debate within European policy circles about whether MiCA’s early advantage is beginning to erode.

Industry reaction to the review has been mixed so far, with some firms welcoming the opportunity to address specific implementation problems they have encountered, and others expressing concern that reopening a framework this early risks introducing new uncertainty into a market that had only recently adjusted to MiCA’s original requirements. The consultation process typically takes several months before any formal legislative changes would be proposed, meaning any resulting revisions to MiCA are unlikely to take effect before 2027 at the earliest.

National regulators across the bloc have applied MiCA’s licensing and supervisory standards with varying degrees of rigor since the framework took effect, a gap that has occasionally allowed firms to secure a license from a comparatively lenient regulator and then passport that approval across the entire EU regardless of how other member states might have evaluated the same application. Closing that gap consistently is expected to be one of the harder problems the Commission’s review will need to address, since it touches on the authority of individual national regulators rather than a single rule the Commission can simply rewrite unilaterally.
